Terms and Conditions for Online Programs

This is a binding legal contract. Please read it in full. By signing up to receive the free bundle (“Bundle”), or any other free resources provided by The Holistic & Functional Psychology Institute (“we,” “us,” or “our”), you (“you” or “the subscriber”) agree to the following Terms and Conditions:

1. Informational Purposes Only

The materials contained within our online programs are provided for educational and informational purposes only. They are not intended as medical advice, diagnosis, psychotherapy, counseling, professional advice, or professional services. Use of the information is at your own discretion and risk, and must be applied with your own professional judgment.

2. Hold Harmless Agreement

By accessing or using our online programs you agree to hold harmless The Holistic & Functional Psychology Institute, LLC, its owners, employees, affiliates, contractors, and agents from any and all liability, loss, or damages — direct or indirect — arising from your use or misuse of the materials.

3. Responsibility to Verify Professional Use

If you are a licensed or credentialed professional, you acknowledge and agree that:

  • You are solely responsible for verifying with your licensing board(s), credentialing bodies, lawyer, and liability insurance providers whether and how our course materials may be used in your professional work.

  • The Holistic & Functional Psychology Institute makes no guarantees that the use of these materials is permissible under any specific license, certification, insurance policy, or jurisdiction.

  • You are responsible for verifying the materials' validity before using, and ensuring they are properly truthful. 

4. Intellectual Property and Copyright

All materials included in our online programs, free or paid, are the exclusive intellectual property of The Holistic & Functional Psychology Institute and are protected under applicable copyright and intellectual property laws.
You may not:

  • Sell, resell, sublicense, or monetize any part of our programs or free materials.

  • Use the materials to create derivative works, services, courses, or products without obtaining prior written permission.

  • Distribute the materials publicly, post them online, offer them as part of an on-demand offering, or offer them through any commercial or group setting.

  • Distribute the materials to other clinicians who have not enrolled in, or paid for, our programs. 

You may:

  • Use the materials personally for your own education and professional development.

  • Share materials directly with individual clients in one-on-one private sessions.

  • Share materials with live groups that you personally lead, with up to 12 participants. This does not include other professionals unless they are receiving group therapy from you. You must stipulate to any mental health professionals in your therapy group that materials are for their personal therapeutic use only. 

Any permissible sharing must retain all original attribution and copyright notices and may not be altered in any way.

5. Unauthorized Distribution and Penalties

If it is determined that you have distributed any of our program materials outside of individual limited live group client use — including but not limited to:

  • Publishing on websites, membership platforms, or social media

  • Using them in groups with more than 12 participants, workshops, or training events without permission

  • Sharing them with other professionals

—you agree that:

  • You may be subject to a minimum fine of $500 per violation. Total charges will be decided based on the extent of the violation, and may be much larger than $500. 

  • You may be responsible for additional damages and legal remedies to protect the Institute’s intellectual property rights.

6. Consent to Receive Communications

By accessing our programs, you are consenting to receive email communications from The Holistic & Functional Psychology Institute, including newsletters, educational content, promotions, and announcements about the program you signed up for, or other programs.
You may unsubscribe at any time via the “unsubscribe” link included in each email. Please be advised that, by unsubscribing, you may miss important information about the program you signed up for. 

7. Changes to These Terms

We reserve the right to update or modify these Terms and Conditions at any time.
Changes will become effective immediately upon posting, and your continued use of the Bundle materials constitutes your acceptance of the updated terms.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to conflict of law principles.

9. No Guarantees

The Holistic & Functional Psychology Institute makes no guarantees or warranties, express or implied, regarding any outcomes, results, or success from using the Bundle materials.
Your use of the materials is voluntary, and results may vary based on individual circumstances.

10. License Revocation

We reserve the right to revoke your access to the Bundle materials, without notice or refund (if applicable), if you are found to be violating these Terms and Conditions, including but not limited to unauthorized distribution, misuse, or intellectual property infringement. We also reserve the right to revoke access to Bundle materials or any free materials if we decide to update or replace the content. 

11. Cancellation Policy - When We Cancel

In the rare event that the training is canceled by the organizer due to unforeseen circumstances (such as illness, technical failure, or emergency), participants will be given the option to transfer their registration to a rescheduled training date. If the training is not rescheduled, participants will be given the offer of either a refund or a credit for future use for other classes. 

12. Cancellation Policy - When You Cancel

We understand that extenuating circumstances arise and you may not be able to attend a program you originally planned to attend. If you can no longer attend, you have several options:

1. You can postpone your registration to a future training, less a $25 admin fee. Future trainings may be the same one you originally signed up for, or a different training. 

2. You may participate in the training on-demand. Continuing education may or may not be granted in this case - see the individual training for details on CE credit. 

3. You may withdraw completely and either transfer the spot to another participant of your choice, or forego your payment. 

13. Refund Policy

Due to limited capacity for live trainings and immediate access to digital materials, we are unable to issue refunds. However, you are welcome to transfer your payment to a future course (for live trainings) or another participant, in accordance with the cancellation policy above, provided you have not seen any of the program materials yet. On-demand trainings are non-refundable and non-transferable due to immediate access. If you are unsure about purchasing, we encourage reviewing course details or contacting us prior to purchase.

14. Consent to Record

The Holistic & Functional Psychology Institute (HFPI) may record live trainings for future on-demand use. By participating in a live training, you consent to the recording and understand that it may be viewed by individuals beyond the live session. If you have concerns about your identity being visible or shared, you may modify your Zoom display name (e.g., use initials or an alias), and refrain from enabling video or sharing personal information during discussions. HFPI will make reasonable efforts to minimize the exposure of identifying details in published recordings.

15. Continuing Education

As of April 2025, The Holistic & Functional Psychology Institute (HFPI) is in the process of obtaining continuing education (CE) approval. Programs purchased before full approval is granted may not be accepted by your licensing board for CE credit.

If a course is later approved by a credentialing body, it is your sole responsibility to verify with your specific licensing board whether the CE credits meet their requirements. HFPI does not guarantee that any CE credits will be accepted by your board, as standards vary across professions and jurisdictions. Please confirm eligibility with your board before purchasing or completing any course for CE credit.

16. Confidentiality of Participant Information

We are committed to protecting your privacy. Information you provide for registration or participation will only be used for course administration, CE documentation, recording for future on-demand offerings, and direct communication regarding relevant offerings. We do not share participant information with third parties without consent, unless required by law.

17. Participant Complaints and Dispute Resolution Process

We are committed to maintaining a high standard of quality and professionalism in all programs. If a participant has a complaint or dispute related to program content, access, certification, or instructor conduct, they must submit the concern in writing within 15 days of the issue. Complaints should be emailed to holistichealthwithemma@gmail.com and must include the participant's name, the course involved, a description of the issue, and any supporting documentation. Complaints will be acknowledged within 5 business days and reviewed promptly. A formal response will be provided within 14 business days. If the participant is not satisfied with the resolution, they may submit one written appeal, which will be reviewed within the same timeframe as the original complaint. Decisions on appeals are final.

18. Duty to Read

I accept that under this agreement, I have a duty to read this agreement and the policies, and have done so. Furthermore, I understand and accept that I am precluded from using lack of reading as a defense against all remedies contained herein.​

If you do not agree to these Terms and Conditions, please do not access or use our programs or any other materials offered by or on this website. By making any purchase or download on our website, you agree to be bound by these terms.
